Article 2: The purchasing system through the website www.new.school-uniforms.it requires an active intervention from the customer, who has already had the opportunity to view the  merchandise at the partner school, before purchasing it. The system has been made in full  compliance with the legislation in matter of trade outside commercial premises and in particular to  art. 45 and following (Codice del consumo – D. Lgs n. 206 September 6th, 2005).

Article 3: These general conditions of sale are applicable to all the sales made through the website  www.new.school-uniforms.it, having viewed the products at the partner school and at the store in  Milan, Via Gesù 17, with delivery throughout Italy.  

Article 4: These conditions of sale must be accurately examined by the customer before completing  the purchase procedure outside commercial premises. 

It is understood that the execution of your purchase order through the website www.new.school uniforms.it implies total and absolute knowledge of these general conditions of sale and their full acceptance. When the customer sends his order through the designated button on the website  www.new.school-uniforms.it, he accepts these general conditions of sale and commits to observing  them, in dealings with LM SCHOOL-UNIFORMS. The customer also agrees to pay the ordered  products in compliance with the payment conditions described below, declaring to have read and  accepted all the indications provided to him. The customer acknowledges that LM SCHOOL UNIFORMS is not considered subject to conditions different from these.  

These general conditions of sale at a distance are to be considered applicable and effective as long  as they are accessible from the website www.new.school-uniforms.it. 

The possible elimination of these general conditions of sale from the website www.new.school uniforms.it implies the automatic and irrevocable inapplicability, ineffectiveness and  unenforceability to LM SCHOOL-UNIFORMS of these conditions, in relation to purchases made  after their elimination from the website. This also applies in the event that these general conditions  were available and accessible to the public on other websites different from www.new.school uniforms.it.  

In relation to sales of customised products, specific conditions (described below) on the sale of  customised items will apply. 

Article 5: ORDERING OF PRODUCTS  

Orders can be made in Italian or English through the Italian section and the English section of the  website www.new.school-uniforms.it , upon registration. Before placing the order, the customer  takes responsibility for checking the accuracy of the details provided. 

Article 6: TERMS OF PAYMENT  

The payment from the customer who buys through the website www.new.school-uniforms.it can be  carried out as follows: via credit card released in Italy. Visa, Mastercard are accepted; American  Express is not accepted. For payment purposes, the customer confirms that he is the title holder of  the indicated credit card and that the name on the credit card is his name; the customer provides the  number, expiry date and security code indicated on the credit card. In the event that, for any reason,  the charge of the required amount shows impossible the sale process is automatically annulled and  the sale is automatically cancelled. All the orders and sales for which the payment is not received  within 10 days will also be considered annulled and cancelled.  

Via bank transfer. The customer will find the bank details to use by clicking on the designated  button. In order to consider the order valid, the payment must be received within 10 days from the  date of its execution. Once this time frame has passed, in the event of a lack of payment, the order  will be automatically annulled. 

The number of your order must be indicated in the reason for the payment. 

Article 7: DELIVERY  

The customer can contact LM SCHOOL-UNIFORMS for any information about the delivery of the  items, by writing at the address info@school-uniforms.it. The delivery of the products is made at  the address indicated in the order by the customer, within the Italian territory, only after the regular  registration of the payment of the related order. The delivery is made through express courier in the  dates established in the calendar of the school uniforms orders, published on the website 

www.new.school-uniforms.it in the section of each school. In the event that, at the moment of the  delivery, the aspect of the package presents some imperfections, the customer (or the person who  received the product) has to open the package in the presence of the carrier, to verify the condition  of the products contained. In the event that the product is damaged, the customer (or the receiver)  has to detail in writing all the identified damages on the delivery note.  

Article 8: RIGHT OF WITHDRAWAL AND RETURN OF PRODUCTS  LM SCHOOL-UNIFORMS is aware that customers can exercise the right of withdrawal provided  for in article 52 of the Codice del Consumo. It is in the interest of LM SCHOOL-UNIFORMS that  the customer can exercise the right of withdrawal in the best possible conditions. The right of  withdrawal is exercised by sending a written communication to LM SCHOOL-UNIFORMS Via  Gesù 17, 20121 Milan (MI), through registered letter with acknowledgement of receipt within 14 days from the date the order was placed. The communication can also be sent, within the same  timeframe, with an e-mail at info@school-uniforms.it providing that it is confirmed by registered  letter with acknowledgement of receipt within the following 48 hours. The delivery date of the  registered mail of the post office will be attested. The customer can exercise the right of withdrawal  by returning the received products within 14 days from the date of delivery, with their original  packaging (boxes, accessories, tags, protections, leaflets, cellophanes…) together with the complete  delivery note and a copy of the invoice or of the receipt. The credit card/account details used for  the payment must also be provided to the following address: LM SCHOOL UNIFORMS Via Gesù  17 20121 Milan (MI). The customer must also specify if he intends to receive a refund of the paid  amount or, alternatively, to obtain the replacement of the received item, as specified in the article 10  below.  

Article 9: COMPLIANCE 

The customer is required to verify that the received products correspond to those in the order  placed. In the event that the delivered products do not comply with the order, the customer must  inform the seller without any delay by writing to the e-mail address info@school-uniforms.it and  return the products in question. The provisions of art. 8 of these general conditions of sale will in  that case apply, when compatible.  

Article 10: RETURN OF PRODUCTS PROCEDURE AND REPLACEMENT  LIMITATIONS  

Without prejudice to the protection deriving from the product warranty (art. 130 – Codice del  Consumo), the replacement of remotely purchased products can only be made with other products  of the same model but of different size. Within 10 (ten) days from the delivery date the customer  can, if need be, ask for the replacement of the purchased products that have been delivered in a  different size from the one ordered. In order to proceed with the replacement, the customer has to  write to the e-mail address info@school-uniforms.it and return the received products, in their  original packaging (boxes, cellophanes, accessories, tags, protections, leaflets…), together with the  purchase receipt and with the change form filled out as required at the store in Via Gesù 17, 20121  Milan (MI). The proof of return of the products is chargeable to the customer who, in the event of  shipping, has to return the products through registered mail with receipt of return at his expense.  The transport costs of the new product are instead chargeable to LM SCHOOL-UNIFORMS, only  in the event that the delivered products are not compliant to those ordered or they show evident  flaws, as provided by the art. 130 (Codice del Consumo). In any case, LM SCHOOL-UNIFORMS  will not make any new shipping before having received the returned items from the customer.  Whatever the option chosen, the products returned by the customer that are damaged, incomplete,  ruined and/or dirty or in any condition that unequivocally implies that the products have been used,  in a way that compromises their substantial integrity, will not be replaced. 

Article 11: FORCE MAJEURE  

The execution of the services from LM SCHOOL-UNIFORMS can be suspended in the event of  occurrence of a fortuitous event or of force majeure that prevents or delays the execution. Examples  are, but without limitation to it, war, turmoils, insurrections, strikes and supply problems of LM  SCHOOL-UNIFORMS attributable to third-party suppliers, or erroneous indication of the correct  delivery address from the customer. LM SCHOOL-UNIFORMS will inform the customer about the  occurrence of the fortuitous event or of force majeure within 7 days from the occurrence of it.  

Article 12: SPECIAL SELLING CONDITIONS OF CUSTOMISED PRODUCTS  LM SCHOOL-UNIFORMS also offers to its customers a customising service for some items.  Considering the clearly customised nature of these products, they cannot be returned, refunded or  replaced. In relation to them is therefore excluded the right of withdrawal of the customer. As a  consequence, the articles 8 and 10 of the general conditions of sale mentioned above will not be  applicable to the sales of customised products.
